By copying, executing or otherwise using the SOFTWARE, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA or it contradicts your national or local laws, you must stop using the SOFTWARE and remove all files of the SOFTWARE from your data medium. 1. GRANT OF LICENSE 1.1. NON-COMMERCIAL USE ONLY You may use the SOFTWARE for personal non-commercial purposes only. The SOFTWARE usage in commercial companies and any use of the SOFTWARE which result in direct or indirect benefit are prohibited. In particular, any persons or organizations which provide data recovery services as well as employees of such organizations may not use the SOFTWARE. You may use the SOFTWARE on a hardware or data medium which is owned or leased by you only. 1.2. RUN ONE COPY PER LICENSE ONLY You may run simultaneously no more active SOFTWARE copies (keep a number of unfinished processes) than a number of license copies provided for you. If the number of license copies is not specified expressly then it is equal to one (1) and you may run a single copy of the SOFTWARE at a time only. You can see the number of license copies and the maintenance end date (support) in the SOFTWARE information box "About..." (command "About..." in the menu "Help"). If the SOFTWARE is provided as a set of multiple versions (e.g., versions for different operating systems or different interface versions) then all these versions are licensed as a single product. In particular, simultaneous run of several versions implies the run of several SOFTWARE copies. Additionally you may create and keep two (2) passive backup copies. 1.3. ENVIRONMENT CHANGE RESTRICTIONS You may run the SOFTWARE alternately on different (or modified) hardware provided that you use the SOFTWARE no more than on two (2) different (or modified) hardware. Motherboard or CPU change, change of the motherboard serial number stored in the computer ROM, the use of virtualization imply hardware modification. After the maintenance period ends you may continue using the SOFTWARE on the same hardware but the maintenance of operability is not provided in any cases of functionality loss including the loss of the SOFTWARE, key loss, or any changes in the hardware or software environment. 2. ACTIVATION The SOFTWARE may require activation. You can use Online Activation (if applicable and the computer is connected to the Internet) and Offline Activation (manually get activation key on the activation site). Some changes to your computer components or the software may require you to reactivate the SOFTWARE. Activation is designed to reveal and prevent unlicensed use of the SOFTWARE. You are not permitted to bypass or circumvent activation. You may not hide the SOFTWARE usage by using emulated, virtual, duplicated, cloned or remote hardware or devices or bypass access to the SOFTWARE activation sites or use another ways of hiding. 3. SOFTWARE UPDATES After the release of an updated version the support for older versions may be terminated. In such case the new license agreement replaces the previous agreements in those stipulations which clarify and enhance the end-user rights. In other cases SOFTWARE updates are used entirely under the terms of the new license agreement. 4. SOFTWARE UPGRADES Upgrade is a change of the complete set, the number of licenses, or license conditions. To apply the SOFTWARE upgrade, you must first be licensed for the SOFTWARE that is eligible for the upgrade. Upon upgrade, new agreement supersedes the previous agreements. After upgrade you may no longer use the SOFTWARE you upgraded from. 5. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS You may not modify, reverse engineer, decompile, disassemble or create other derivative works based on the SOFTWARE, except as required by the law. You may not use, copy, emulate, clone, rent, lease, sell or transfer the SOFTWARE or any subset of the SOFTWARE, except as provided for in this agreement. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution. The SOFTWARE is licensed as a single product. Its component parts may not be separated for use on more than one computer. All rights not expressly granted here are reserved by the author of the SOFTWARE. 6. LIMITED WARRANTY THE AUTHOR OF THE SOFTWARE EXPRESSLY DISCLAIMS ANY WARRANTY FOR THE SOFTWARE. THE SOFTWARE AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU. IN NO EVENT SHALL THE AUTHOR OF THE SOFTWARE BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF USE OR INABILITY TO USE THE SOFTWARE (INCLUDING BUT NOT LIMITED TO ANY DATA LOSS OR DISTORTION, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, PERSONAL INJURY, LOSS OF PRIVACY OR OTHER PECUNIARY OR OTHER LOSS WHATSOEVER), EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
